We have adopted a child in India under Guardianship & Wards Act (GAWA). Now as Juvenile Justice Act (JJ Act) is in place to adopt, can we readopt under the JJ Act?
I am not sure for certain but my gut feeling is that you can do it. Although under guardianship act, intent is to adopt and the child is under your custody. All that you may be doing now is to do it under the appropriate legislation that has been passed after your adoption under the guardianship act. Change is only on paper and not on the status of your relationship with your child.
Check with a lawyer who may be into adoption laws.
