Free Tax Course

Adoption Tax Credit Extended!!!

Just read on another site that the adoption tax credit is now legally extended through 2011, there is even an increase in the amount!

It passed through with the new health care bill, so no matter what side you were on of it passing, this is a good reason to be excited. Last push.....please help

As you may know that I have been working on “Adoption Tax Credit” for the past seven months and we have reached the last stage now. In this stage, our case will be presented to the Finance Minister of India before he presents India’s budget by end of this month. Please continue to read this message and you’ll see how you can participate in this campaign to become a change agent.

In the last line (look at the image below to have an idea) where it says “I want (anything else, please elaborate)” cut and paste the message given below and send it. I would like our Finance Minister to announce "Adoption Tax Credit" (amount equal to the maximum allowable adoption expense per child stipulated by the government of India - approximately 25,000 rupees). This can be made as part of list of 80C deductions. This will help adoptive families to plan to finance their adoption expenses apart from enabling a common man to find financial relief when adopts a child. This credit will promote the message of adoption, streamline the process, and make adoptions more transparent and accountable. Adoption Tax Credit can pay itself by non-disbursal of funds that are due under "Shishu Greh" scheme when more children are placed in homes. This is a progressive, and family friendly suggestion in the best interest of an orphan child.

Adoption tax credit Q & A

Why not advocate for free adoptions in India than “Adoption Tax Credit”?

It’s a question in sincere in spirit but as we all know that anything that’s offered at no cost has little or virtually no value. Moreover, when there are multiple legitimate stakeholders, the empowerment makes the process streamlined apart from imposing strong checks and balances in place.

Adoption Q and A # 23

We have adopted a child in India under Guardianship & Wards Act (GAWA). Now as Juvenile Justice Act (JJ Act) is in place to adopt, can we readopt under the JJ Act?

I am not sure for certain but my gut feeling is that you can do it. Although under guardianship act, intent is to adopt and the child is under your custody. All that you may be doing now is to do it under the appropriate legislation that has been passed after your adoption under the guardianship act. Change is only on paper and not on the status of your relationship with your child.

Check with a lawyer who may be into adoption laws.

Adoption tax credit Q & A

Why and who should sign this petition?

Indian constitution confers equality to all the citizens of India and the price mandate of CARA to adopt a child doesn’t allow people of lower economic status to have an equal opportunity to adopt in India (read the petition [here] to hear the argument). If you’re convinced that your fellow citizen in India could be helped by this petition, then you need to sign.

Although it is desired for every Indian (with in and outside India) to sign this petition, HOPE House is not advocating Indians alone but Individuals who believe in a “Home” as the best place for the overall development of a child to sign and support this petition.

Anyone’s courage to be part of this petition shouldn’t be misconstrued as an approach of confrontationist but a catalyst.

What other benefits can be envisioned by “Adoption Tax Credit” apart from paying for the adoption expenses?

1. By involving tax payers and other stake holders such as businesses on behalf of non tax payers, it could make the adoption process streamlined and more transparent.

2. Indirectly increasing the affordability to the people of lower economic status.

3. Wider awareness about the concept of adoption.

4. Saving for the government (Read the entire petition) by non-disbursal of funds.

5. More children finding homes quickly through adoption.

‘Adoption Tax Credit’ Q & A # 5

When so few people pay taxes in India , doesn’t the “Adoption Tax Credit” be exclusively helping the limited number tax payers?

1. In India , Only less than 5% of working class pays personal income taxes.

2. According to National Advisory Council, 92% or more than 300 million working class belongs to unorganized/ informal sectors and contributing 60% of India’s GDP (By recent estimates, India’s GDP is 1 trillion dollars).

3. 50% of India ’s workers are self employed like small and marginal farmers, artisans, and street vendors. So there’s a danger of excluding these workers of unorganized/ informal sectors by passing “Adoption Tax Credit”.

4. HOPE House is advocating “Adoption Tax Credit” not only for individuals but also for the businesses to extend the benefit to others. To make “Adoption Tax Credit” inclusive of the workers of unorganized/ informal sectors, HOPE House will advocate “Open Access Credit” where any legitimate Indian citizen can avail the financial support from any tax paying entity. Ofcourse "Open Access Credit" requires a strong set of checks and balances to curtail the abuse.

"Adoption Tax Credit" Petition (Q & A # 3)

Why does India need â€Å“Adoption Tax Credit?

Per capita income in India (in 2005 - 2006) as per the Central Statistical Organization (CSO) is Rs. 20,734/-. As per CARA guidelines on costs for domestic adoptions, Shishu Grehs (government funded adoption agencies) can be reimbursed up to Rs. 15,000/- for maintenance and Rs. 9,000/- for medical expenses apart from Rs. 1200/ - towards registration and home study. This means that a child with medical needs could cost as much as Rs. 25,200/- which is far more than the average annual income of an Indian citizen.

What is the supply and demand to justify “Adoption Tax Credit” policy in India?

Domestic adoptions for the year 2006 are estimated by CARA (excluding state recognized adoption agencies) to be 2479 - reversing the trend of dropping numbers which has prevailed since 2002. Different sources state the number of available children for adoption in India to be between 27 000 to 18 million. This is the supply side of the equation.

The 2001 India census states that there are 230 million married couples. Even if one half of one percent is eligible to adopt, that number is 1.1 million couples. This is the demand side of the equation.

In 2006, “The Lancet” a reputed medical journal said that probably the births of up to 10 million girls in India may have been prevented by selective abortion in the past 20 years. If Adoption Tax Credit brings the much needed awareness about the concept of aodption, some day one need not fear about giving birth to a child or to give into adoption than to kill them simply because of their gender.

Do you know of any tax credits/ rebates/ deductions in India that can be used as basis to argue for the adoption tax credit?

Under section 88 of Indian Income Tax Act, any Indian parent is eligible to claim a tax rebate up to 12,000 rupees per child per year for total of two children’s fulltime education (excluding development fee, donations or other payments of similar nature) if the institution (university, college, school or other educational institutions) is located with in India.

Think about this: Is it unreasonable to expect from the Indian Government

When an amount up to 24000 rupees in total is given in education rebate to parents EVERY YEAR, an amount approximately up to 25,000 rupees in “Adoption Tax Credit” for adopting a child ONCE IN A LIFETIME?

When a CHILD WITH PARENTS is given importance, how much more ought to be given to care for a CHILD WITHOUT PARENTS

When EDUCATION is given such an importance, how about a HOME?

‘Adoption Tax Credit’ in India Petition

The HOPE House is advocating for a new policy in India to extend Adoption Tax Credit to enable affordability to all the Indians irrespective of their economic status. If you're convinced as much as we are, kindly support this by signing this petition and forwarding it to your friends.

Our goal is to collect at least 100,000 signatures by end of October 2007, and then in November (Adoption Awareness Month), petition will be carried in a rally throug major cities of India to the capital to submit to the Ministry of Women and Child Development.
